Terms of Service

These Terms govern access to Synphoria websites, applications, and related services. By using Synphoria, you agree to these Terms and incorporated policies.

1. About these terms

These Terms form a legally binding agreement between you and SYNPHORIAAI sp. z o.o. The Privacy Policy, Cookie Policy, Safeguarding Policy, and Data Safety & Security Statement are incorporated by reference.

2. Eligibility and accounts

You must be at least 16 years old. You are responsible for accurate account information, safeguarding your credentials, and all activity under your account.

3. Service nature and limitations

  • Synphoria is a non-clinical emotional support product.
  • It does not provide medical diagnosis, treatment, or emergency services.
  • AI output may be incomplete or inaccurate and must be used with judgment.

4. Safety and safeguarding

Synphoria may use automated risk indicators and short context windows to detect potential safeguarding events. Exceptional human review may occur under strict governance when serious risk is identified.

5. User content and AI output

You retain rights in your content and grant Synphoria a limited licence to host, process, and display content to operate and secure the Service. Output may not be unique.

6. Acceptable use

You must not use the Service to violate law, harm others, bypass safeguards, reverse engineer proprietary components, or operate high-risk use cases where errors could cause severe harm.

7. Subscriptions, billing, and refunds

Paid plans may auto-renew. Pricing and plan features are shown at checkout. Payments are handled by third-party processors. Refunds are provided where required by law or explicitly stated.

8. Intellectual property

Service software, design, trademarks, and proprietary systems are owned by Synphoria or its licensors and are protected by applicable law.

9. Third-party services

Synphoria may rely on third-party identity, payments, hosting, messaging, analytics, and model providers. Their services are governed by their own terms and policies.

10. Suspension and termination

We may suspend or terminate accounts for policy violations, security or safeguarding concerns, legal obligations, or service abuse.

11. Disclaimers

The Service and AI output are provided 'as is' and 'as available' to the maximum extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, Synphoria limits liability for indirect, incidental, and consequential losses. Mandatory legal protections remain unaffected.

13. Governing law and disputes

These Terms are governed by Polish law, subject to mandatory consumer protections. Before filing formal claims, users should contact contact@synphoria.app for informal resolution.

14. Changes to terms

We may update these Terms periodically. Material updates are communicated through the Service or email where appropriate.
